Resolution to approve and appropriate FY16 hazmat recovery funds from the Hazmat Restricted Fund Balance to Hampton Division of Fire & Rescue's FY17 budget

 

Purpose

PURPOSE/BACKGROUND:

Hampton Division of Fire & Rescue uses previous fiscal year's hazmat recovery funds to support the current fiscal year's hazmat equipment and supply needs. Therefore, FY16 hazmat recovery funds should be approved and appropriated to Hampton Division of Fire & Rescue's current FY17 budget.

Hampton Division of Fire & Rescue would like the City Council to approve and appropriate hazmat recovery funds to their FY17 budget.

 

Body

                     WHEREAS, the Commonwealth of Virginia, Code of Virginia, Title 15-2 Counties, Cities, and Towns, Chapter 9 General Powers of Local Government, Virginia Code 15-2-900 Abatement or Removal of nuisances by localities; recovery of cost states that counties, cities, and towns may bring action against the responsible party of a nuisance such as hazardous materials; and

                     WHEREAS, the Hampton, Virginia, Code of Ordinances, Chapter 14 - Fire Prevention and Protection, Article V - Hazardous Materials, Section 14-86 - Establishment of Revolving Account states that the City has a Hazmat Revolving Account within the general fund; and

 

                     WHEREAS, the Hampton, Virginia, Code of Ordinances, Chapter 14 - Fire Prevention and Protection, Article V - Hazardous Materials, Section 14-87 Disposition of Funds Collected states that all funds collected shall be used for hazardous materials emergencies and to recoup costs associated with a response to a hazardous materials emergency.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA to approve and appropriate the FY16 hazmat recovery funds from the Hazmat Restricted Fund Balance to the Hampton Division of Fire & Rescue’s FY17 budget in the amount of $26,272.80.
