Ordinance to Amend and Reenact Chapter 2, Entitled "Administration", of the Code of the City of Hampton, Article XIV, “Procurement Office,” by Amending Section 2-324 and Section 2-326 to Comply With New Federal Grant Procurement Standards

 

Purpose

PURPOSE/BACKGROUND:

As a non-federal entity these amendments are required to comply with the new Federal Grant Procurement Standards for small purchases and sole source procurement.

BE IT ORDAINED by the City Council of Hampton, Virginia, that Section 2-324 and Section 2-326 of Chapter 2, Article XIV, Division 1 of the Code of the City of Hampton, Virginia, be amended to read as follows:

 

Sec. 2-324. - Applicability of, and compliance with, article.

 

(k)                     For a sole source procurement transaction involving the expenditure of federal assistance

                     or grant funds, the item must either only be available from a single source; if it is a case of

                     an emergency as defined in section 2-328; the federal awarding agency expressly

                     authorizes noncompetitive proposals, or after solicitation competition is determined to be

                     inadequate.  

 

Sec. 2-326. - Competitive bidding requirements.

 

                     a.                     For procurements not exceeding five thousand dollars ($5,000.00) city departments

                                          shall solicit at least two (2) price quotes and at least one (1) quote shall be solicited

                                          from a                     minority-owned or woman-owned business enterprise, whenever feasible.

                                          Quotes may be obtained either orally or in writing.
