Ordinance To Amend Chapter 21 Of The Code Of The City Of Hampton, Virginia By Repealing Section 21-188, Entitled "Distribution of Handbills, Solicitation Of Contributions And Sales Of Goods Or Services On Public Roads And Designated Highways Prohibited"

 

Purpose

PURPOSE/BACKGROUND:

 

Recent developments in case law have clarified methods a locality may use to address the safety issues associated with solicitation/panhandling on highways.  A repeal of Section 21-188 and instead, focused enforcement of other existing City ordinance such as aggressive solicitation, impeding the flow, and disorderly conduct would provide law enforcement with an effective means of ensuring safety to pedestrians and occupants of motor vehicles.

 

Discussion:

 

Approval of this ordinance will create a strategic opportunity for the City to explore more effective enforcement of public safety in regards to pedestrian interaction with motor vehicles.

 

Impact:

 

This ordinance amendment brings the City's solicitation ordinance into compliance with recent case law.
