Purpose

Background Statement:

Use Permit Application No. 26-0039 is a request to amend the conditions of the applicant’s existing Use Permit for a Restaurant 3 (UP25-0285) to extend the permitted hours of operation and to relax security requirements for the establishment.  The subject property is located at 2163 & 2165 Cunningham Dr [portion of LRSN: 7001532].  The property is currently zoned Limited Commercial (C-2) District, which permits the desired use subject to an approved Use Permit.  A Use Permit for Restaurant 3 was granted by City Council on December 10, 2025 with conditions permitting operation until 2:00 a.m. only on certain days and requiring a certain number of security personnel to monitor and control patron behavior.  The applicant desires to extend the operational hours to 2:00 AM daily and to reduce the number of security personnel, which requires amendment of the existing Use Permit.

 

The Hampton Community Plan (2006, as amended) and Coliseum Central Master Plan (2015, as amended) recommend mixed-use for the subject property.

 

Staff recommends denying the application to amend the existing Use Permit and uphold UP25-0285 and its fourteen (14) conditions as approved.
