Ordinance to Amend and Reenact Section 2-134 of the City Code of the City of Hampton, Virginia, Entitled, “Council Approval Prerequisite to Acceptance of Certain Gifts to City; Gifts for undercover Law Enforcement Investigations; Inventory of Gifts” Pertaining to Property Conveyances to which this Section Shall Not Apply

Purpose
PURPOSE/BACKGROUND:
Hampton City Code Section 2-134(d) requires Council approval for gifts of real property valued at five thousand dollars ($5,000.00) or more, unless the conveyance is required by the Subdivision Code. The City Attorney’s Office (CAO) is proposing an amendment to this provision to allow all acquisitions from governmental entities to be approved administratively by the City Manager/her designee rather than requiring Council action in each instance. This will streamline transactions between the City, HRHA, and EDA. The CAO is also proposing amending the Code to allow conveyances required by any provision of the City Code or Zoning Ordinance to be approved administratively, rather than just those required by the Subdivision Code. This amendment is recommended because the City is actively involved and knowledgeable about the circumstances of those conveyances.

This amendment would be effective when enacted.

BE IT ORDAINED by the Council of the City of Hampton, Virginia, that Section 2-134 of the City Code of the City of Hampton, Virginia be amended and re-enacted as follows:
