Purpose
PURPOSE/BACKGROUND:
The debilitating effects of litter continue to be realized even though littering is decreasing. Nationwide, estimated cleanup costs exceed $11.5 billion per year. Businesses pay approximately $9.1 billion of this amount, with the remainder being covered by state and local governments and other organizations. Indirect costs of litter detrimentally affect property values and aesthetics of communities. Additionally, environmental cleanup legislation was spawned, in part, from litter contaminants.

Virginia Code § 33.2-802 provides more stringent penalties for litter violations than the current city code. Therefore, city code § 32.1-5 is being modified to align with the state code to enhance the city's enforcement capabilities in an effort to raise awareness of the harmful effects of litter, create a healthier environment, and beautify the city.

BE IT ORDAINED by the Council of the City of Hampton, Virginia, that Chapter 32.1 of the Code of the City of Hampton, Virginia entitled “Solid Waste” be amended and re-enacted as follows:

Chapter 32.1 - SOLID WASTE

ARTICLE I. - IN GENERAL

(a) It shall be unlawful for any person to dump or otherwise dispose of refuse, litter, or other unsightly matter on a public highway, right-of-way, property adjacent to such highway or right-of-way, or any other public property, or on private property without the written consent of the owner thereof or his agent.
