Purpose
PURPOSE/BACKGROUND:
The permit fees associated with the Virginia Erosion and Stormwater Management Program include both City and State fees that are revised periodically. The proposed amendment to the City of Hampton’s Stormwater Management and Erosion Control ordinance (Chapter 33.3) removes the table in Section 33.3-45(b) that provided the City land disturbance fees and the State construction general permit fees based upon the area of land disturbance. The amendment will improve consistency with state requirements and eliminate the need for future ordinance amendments for the sole purpose of updating the fees in the said table.

BE IT ORDAINED by the City Council of the City of Hampton, Virginia, that Section 33.3-45(b) of the City Code of the City of Hampton, Virginia be amended and restated to read as follows:

(b) Applicant shall pay a non-refundable fee as set by the City. Fees are based on the acreage associated with the disturbed area and shall be levied to cover the costs of processing and investigating the application for and the inspection of the land-disturbing activity as defined herein. Applicant shall also pay the current State construction general permit fees as published annually by the State.
This Ordinance amendment’s effective date is July 8, 2026.
