Purpose

Background Statement:

Use Permit Application No. 24-0028 is a request for a use permit for a new restaurant 3, which is not yet in operation. The use permit would allow the proposed restaurant to operate beyond what would be permitted under a Zoning Administrator Permit (ZAP) with regard to hours of operation, hours of indoor live entertainment, and indoor live entertainment performance area. The subject property is located at 555 Settlers Landing Road suites M & N (portion of LRSN: 2002950). These are commercial suites at the base of the parking garage facing the plaza with the flag pole. The property is currently zoned Downtown Business (DT-1) District, which allows for the desired use, subject to an approved use permit.

 

If the use permit is to be granted, staff has identified twelve (12) conditions that should be attached based upon the proposed use’s operational and land use characteristics. Among the conditions are limitations on hours of operation for the restaurant. The conditioned evening hours of operation are less restrictive than what is proposed by the applicant and would give the applicant flexibility to change hours in the future. Given the location and other surrounding uses, these conditioned hours proposed by staff are appropriate. The conditioned hours are consistent with other live entertainment and restaurant use permits granted previously in Downtown Hampton.
