Ordinance To Amend And Re-Enact Chapter 1 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “General Provisions” By Amending Section 1-30 Pertaining To General Green Area Requirements


Purpose
Background Statement:
Chapter 1 of the zoning ordinance governs green area requirements in the city. Specifically, unless exempted, Sec. 1-30 requires a minimum of 10% of the land area of the lot be designated as green area

Approval of this amendment would exempt the proposed Fort Monroe (FM) Districts (FM-1, FM-2, FM-3 and FM-4) from the 10% green area requirement. Fort Monroe was designated a National Historic Landmark (NHL) District in 1960. The 2005 BRAC process to close Fort Monroe required the preparation of a Programmatic Agreement under the National Historic Preservation Act to protect the historic buildings and properties in the NHL district. The Programmatic Agreement provides for landscape protection requirements that would be in conflict with the 10% lot area designation for green area. Exemption from the green area requirement in Chapter 1 of the zoning ordinance is recommended to promote new development on Fort Monroe that will be consistent with the historical character of the NHL district.

This amendment is part of a recommendation to amend the Hampton Community Plan (2006 as amended), rezone the Fort Monroe property, and amend the Hampton zoning ordinance to support the closure and reuse of Fort Monroe. The Hampton Community Plan amendment (CPA 16-00001) will establish the “Fort Monroe Land Use Plan (2016)”. The proposed rezonings include: RZ 16-00002, RZ 16-00003, RZ 16-00004, RZ 16-00005, and RZ 16-00006. The proposed zoning ordinance amendments include: ZOA 182-2016, ZOA 183-2016, ZOA 184-2016, ZOA 185-2016, ZOA 186-2016, and ZOA 187-2016.
