Ordinance to Amend and Re-enact the Zoning Ordinance of the City of Hampton, Virginia by Amending Section 2-2 Entitled, “Definitions” Pertaining to Wireless Infrastructure
Purpose
Background Statement:
In recent years, the Federal Communications Commission (FCC) and the Virginia General Assembly adopted new legal criteria governing the installation of wireless infrastructure, which strictly limit City authority to regulate wireless infrastructure, both within City-owned public rights-of-way and upon private property.
City Code amendment #20-0294 addressed these structures in the right-of-way and was approved by City Council on October 14, 2020. This amendment and #20-0300 address these structures upon private property.
Approval of this amendment would add the following definitions: Administrative review-eligible project; Antenna; Applicant; Base station; City facilities; Co-locate; Department; Existing structure; Micro-wireless facility; New structure; Person; Project; Public rights-of-way ; Public street; Public way; Small cell facility; Standard process project; Third Party Existing Structure; Utility pole; Water tower; WIP; Wireless facility; Wireless Infrastructure Permit (WIP); Wireless infrastructure provider; Wireless services; Wireless services provider; and Wireless support structure. It would also update the definition of Commercial building-mounted antenna.
This item is being bought forward in conjunction with Zoning Ordinance Amendment #20-0300 which establishes the zoning regulations for wireless infrastructure.

WHEREAS, the public necessity, convenience, general welfare and good zoning practice so require;
BE IT ORDAINED by the City Council of the City of Hampton, Virginia that Section 2-2 of Chapter 2 of the Zoning Ordinance of the City of Hampton, Virginia be amended to read as follows:
