Purpose

Background Statement:

Use Permit Application No. 24-0490 is a request for a Use Permit for a restaurant 3 to exceed the general hours of operation permitted under a Zoning Administrator Permit (ZAP), to include outdoor dining.  The subject property is located at 1044 W. Mercury Blvd. [LRSN: 7001551], a leased out parcel within the Riverpointe Shopping Center.  The property is currently zoned Limited Commercial (C-2) and Coliseum Central Overlay (O-CC) Districts, which permits the desired use subject to an approved Use Permit.  The applicant desires to extend the operating hours for the existing Raising Cane’s Restaurant.

 

If the Use Permit is granted, staff recommends eight (8) conditions based upon the proposed use’s operational and land use characteristics. Recommended conditions address issuance of permit, hours of operation, window transparency, capacity, prohibition on alcohol sales and service, and compliance with other applicable laws.  Given the location and other surrounding uses, the recommended permitted hours proposed by staff are consistent with other similar fast-food style restaurants that have late night hours.

 

The Hampton Community Plan (2006, as amended) and the Coliseum Central Master Plan (2015, as amended) recommend mixed-use for the subject property.
