Ordinance To Amend And Re-Enact The Zoning Ordinance Of The City Of Hampton, Virginia By Adding And Amending Section 1-37 Entitled, “Accessory Dwelling Units” To Create Regulations and Standards For Accessory Dwelling Units.

Purpose
Background Statement:
The proposed amendment aims to permit Accessory Dwelling Units (ADUs) in conjunction with legally permitted single-family dwellings in multiple zoning districts, including all One- and Two-Family Residential (R) Districts. The proposed regulations and standards for ADUs include regulations and development standards for both attached and detached ADUs such as the number permitted per lot, the minimum lot size, setbacks, square footage requirements, exterior access location(s), and excluded uses.

This amendment is being advanced in coordination with related Zoning Ordinance Amendments:

ZOA 25-0019: Defines “Accessory Dwelling Unit (ADU)” and amends the existing definition of “Dwelling Area” (Chapter 2).
ZOA 25-0268: Eliminating permitted additional standards and uses in the R-R District and adding minimum dwelling area requirements for all principal dwellings in One- and Two-Family (R) Districts (Chapter 4).
ZOA 25-0269: Amending parking requirements for ADUs in all One- and Two-Family Residential Districts (Chapter 11).

In summary, staff recommends adoption of the proposed amendment to create regulations and standards for accessory dwelling units. Planning Commission recommends approval with amendments to change the required side setback for detached ADUs from three (3) feet to five (5) feet; and to add language stating that the standards in this section shall supersede the existing ADU regulations for the Buckroe Bayfront (BB-1, BB-2, and BB-3) Districts.
