Discussion:
The City of Hampton is authorized pursuant to Code of Virginia Section 15.2-2114, as it may be amended from time to time, to establish a utility or enact a system of service charges to support a local stormwater management program. That section further provides that the CIty may charge and collect compensation for such services. The proposed increase to the Stormwater User Fee will enable the City's Stormwater Management Fund to continue to operate efficiently and address flooding issues city-wide.
Pursuant to Hampton City Code Section 33.2-34, the service charge for (i) each residential property shall equal the rate for one equivalent residential unit ("ERU"); and (ii) each developed nonresidential property (commercial property) shall be the ERU rate multiplied by fraction that is the total impervious surface area square footage divided by 2,429 (the square footage contained in one ERU).
Notice of this fee increase was included in the advertisements for the public hearings for the City Manager's Recommended Budget for Fiscal Year 2022 that ran in the Daily Press on April 18, 2021 and April 25, 2021.
Impact: The net increase is approximately $1,000,000.
Recommendation:
