Ordinance to Amend And Re-Enact Chapter 9 Of The Zoning Ordinance Of The City of Hampton, Virginia Entitled “Overlay Districts” By Amending Article 2, “O-CBP District - Chesapeake Bay Preservation Overlay"

Purpose
Background Statement:
This amendment is paired with ZOA No.17-00004; the two amendments being alternatives for which body hears exception cases, with the rest of the ordinance being the same. ZOA No.17-00004 was heard by the Planning Commission in July, and the Commission recommended approval. City Council requested additional time to better understand the Chesapeake Bay Preservation District and consider options related to the accompanying amendment, ZOA No.17-00004. So, at the August legislative session, City Council referred the zoning ordinance amendments back to Planning Commission. With the additional research and feedback from City Council, the proposed amendment 17-00004 was largely unchanged from the previous proposal when it came before Planning Commission in November.

At the November meeting, a Planning Commissioner restated particular interest in contemplating which body hears exception requests separate from the rest of the ordinance. The Commission as a whole agreed to having that discussion and voted to defer the zoning ordinance amendment so staff could bring forward another option. This allows the Commission to contemplate support for exception requests being heard by the Board of Zoning appeals separate from the rest of the ordinance.

Zoning Ordinance Amendment No.17-00015 proposes retaining the current Chesapeake Bay Review Committee, while retaining all of the other changes of 17-00004. The Chesapeake Bay Review Committee is a board made up of four members of City staff and the chairperson of the Wetlands Board.
