Medical Marijuana Zoning Interpretation Briefing
Purpose
PURPOSE/BACKGROUND:
Virginia has recently passed legislation that will allow the production of a cannabinoid-type oil for various medicinal purposes. This oil is produced from the marijuana plant. Interested parties are now pursuing permits from the State to allow a limited number of these facilities to be operational across Virginia. Since this use has only recently been declared “legal,” it presents some challenges from a zoning perspective since almost no zoning ordinance in the Commonwealth specifically addresses this type of land use.
City staff will brief City Council regarding our zoning interpretation regarding where this use would be currently permitted under the existing zoning ordinance.
