Purpose
PURPOSE/BACKGROUND:
These are housekeeping amendments to bring City Code into compliance with Virginia Code due to statutory changes made by the 2018 General Assembly to enable legislation relating to the definitions of abandon and boarding establishment. Amendments are necessary to remain in compliance with state code.

These amendments will go into effect on July 1, 2018.


Discussion:

Approval of these amendments will ensure that Hampton’s animal-related ordinances comply with the provisions of the Code of Virginia.

BE IT ORDAINED by the City Council of the City of Hampton, Virginia, that Chapter 5 of the City Code of the City of Hampton, Virginia be amended to read as follows:

CHAPTER 5 - ANIMALS

Sec. 5-2. - Definitions.
Unless otherwise expressly stated or the content clearly indicates a different intention, the following words and terms shall, for the purposes of this chapter, have the meaning indicated in this section:

Abandon means to desert, forsake, or absolutely give up an animal without having secured another owner or custodian for the animal or by failing to provide the elements of basic care as set forth in Virginia Code § 3.2-6503 for a period of four (4) consecutive days.

Boarding establishment means a place or establishment, other than public or private animal shelter, where companion animals not owned by the proprietor are sheltered, fed and watered in exchange for a fee. This shall not include any private residential dwelling that shelters, feeds, and waters fewer than five (5) companion animals not owned by the proprietor.
