Purpose

PURPOSE/BACKGROUND:

The purpose of this resolution is to determine LexisNexis and subdivision Matthew Bender to be the only source practically available from which to procure sole source law materials, including the Code of Virginia and Michie's Jurisprudence.  The print materials we receive from LexisNexis and subdivision Matthew Bender are not published by other companies.

 

Discussion:

 

In July of 2000, City Council of the City of Hampton, Virginia approved Lexis Law Publishing to be the Only Source Practically Available from which to procure major sources of Virginia Law Materials.  The approved resolution listed the company title as Lexis Law Publishing.  The correct title is LexisNexis.

 

LexisNexis is the sole source for many law materials, including the Code of Virginia and Michie's Jurisprudence, major sources of Virginia law information used by legal professionals.  The print materials we receive from them are not published by other companies.  In 1998, LexisNexis purchased Matthew Bender which is one of the world's largest publishers of legal analysis and case law.  These publications are used extensively by the judges, attorneys and legal counsel of the City of Hampton.

 

Impact:

 

An agreement with Lexis Nexis and subdivision Matthew Bender would be long-term with purchases and subscriptions made on an annual basis.  The George Wythe Law Library generally spends $12,000 annually with LexisNexis and Matthew Bender.

Body

                     WHEREAS, Hampton City Council previously approved authorization for the City Manager or designee to execute a contract between the City and Lexis Law Publishing to purchase law materials, many of which are sole source publications;

 

                     WHEREAS, LexisNexis and subdivision Matthew Bender is the exclusive provider of major sources of Virginia Law Materials including the Code of Virginia and Michie's Jurisprudence which the city desires for use of legal professionals in the City of Hampton; and

 

                     WHEREAS, the price at which LexisNexis and subdivision Matthew Bender has offered the legal publications has been determined to be fair and reasonable.

 

                     NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:

 

                     1.                     That the contract for procuring goods and services described above may be negotiated and awarded to LexisNexis and subdivision Matthew Bender as a “sole source” without competitive sealed bidding or competitive negotiation as set forth in Virginia Code Section 2.2-4303.E;

 

                     2.                     That the City Manager or his authorized designee is hereby authorized to negotiate and execute a purchase contract with LexisNexis and subdivision Matthew Bender; and

 

                     3.                     That the notice awarding the contract to LexisNexis and subdivision Matthew Bender shall be posted in a public place pursuant to Virginia Code Section 2.2-4303.E.
