Resolution of the City Council of the City of Hampton, Virginia to Delegate to the City Manager Authority to Appoint Members of the Hampton Employees' Retirement System Board

 

Purpose

PURPOSE/BACKGROUND:

Discussion:

 

The City Council of the City of Hampton, just prior to this proposed action, considered and approved certain revisions to Sections 2-2 and 28-43 as they pertain to appointees of the Hampton Employee's Retirement System Board.  The purpose of those revisions is to not limit the City Council appointees of that Board to only City residents, and to employees or former employees who participate in the plan.  In addition, those revisions allow the City Council to delegate its appointment authority to the City Manager, which is the purpose of this proposed resolution.

Body

 

                     WHEREAS,  the Hampton Employees' Retirement System ("HERS") was established in 1966;

 

                     WHEREAS, HERS is managed and administered by a Board of Trustees comprised of certain appointees, as prescribed by Hampton City Code Sec. 28-43(a)(4); and

 

                     WHEREAS, pursuant to Hampton City Code Sec. 28-43(a)(4), the City Council is authorized to delegate its appointment authority under that section to the City Manager.

 

                     NOW THEREFORE, be it resolved by the City Council of the City of Hampton, Virginia that pursuant to Hampton City Code Sec. 28-43(a)(4); it hereby delegates to the City Manager its authority to appoint members of the HERS Board of Trustees, as set forth in that ordinance, and subject only to those other requirements as may be set forth the the laws of the Commonwealth of Virginia, the Hampton City Charter, and the Hampton City Code.
