Ordinance to Amend and Reenact the City Code of the City of Hampton, Virginia by Amending Chapter 33.2, Titled “Stormwater Management,” Article IV, Titled "Service Charges and Revenues,” Section 33.2-35, Titled “Same-Billing, Payment, Interest, Fee and Lien
Purpose
PURPOSE/BACKGROUND:
Ordinance to Increase the Stormwater Fee for Fiscal Year Beginning July 1, 2019 and Ending June 30, 2020 Pursuant to Virginia Code Section 15.2-2114.
Discussion:
The City of Hampton is authorized pursuant to Code of Virginia Sec. 15.2-2114 to establish a utility or enact a system of service charges to support a local stormwater management program. That section further provides that the CIty may charge and collect compensation for such services. The proposed increase to the Stormwater User Fee will enable the City's Stormwater Enterprise Fund to continue to operate efficiently and address flooding issues city-wide.
Impact:The net increase is approximatly $1,000,000.

BE IT ORDAINED by the City Council of the City of Hampton, Virginia, that Section 33.2-35(c) of the City Code of the City of Hampton, Virginia be amended and restated to read as follows:

Sec. 33.2-35. - Same-Billing, payment, interest, fee and lien.

(c) The service charge due the city from property owners for stormwater management shall be based on the rate of $105.96 per ERU per year. When applicable, the service charge shall be prorated at $8.83 per ERU per month or any part thereof.
