Resolution Authorizing the Execution of a Programmatic Project Administration Agreement for Revenue Sharing Program Projects with the Virginia Department of Transportation

Discussion:

 

Pursuant to Code of Virginia § 33.2-357, certain revenues made available by the General Assembly and appropriated for the improvement, construction, reconstruction, or maintenance of state highways may be made available to localities through the Commonwealth Transportation Board, subject to the Virginia Department of Transportation (“VDOT”) contracting with localities for the implementation of those projects.

 

For that purpose, VDOT has presented to the City a “Programmatic Project Administration Agreement” for all active current and future Revenue Sharing Projects for a minimum of the next three (3) years with an additional three (3) year renewal option.  The City previously entered into such an agreement in 2013 that also had a maximum life of six (6) fiscal years and is expiring on 6/30/19.  Accordingly, it is necessary for the City and VDOT to enter into a new agreement to continue to allow a streamlined Revenue Sharing project agreement process.

 

The terms of the attached agreement have been reviewed and conform with our legal standards.   The matter remaining before the City Manager's exection is a mutual understanding between the City and VDOT regarding the information to be (currently) included in the appendices.

 

Impact:

 

This agreement facilities improvement of certain of the City's roadways, and provides for the sharing of those costs (which can be substantial) with VDOT.

Body

                     WHEREAS, the Virginia Department of Transportation (“VDOT”), through its Revenue Sharing Program, has offered the City of Hampton (the “City”) Revenue Sharing funds for use on roadway improvement projects on a 50/50 VDOT/City share basis;

 

                     WHEREAS, the VDOT share of those funds is paid on a reimbursement basis following the expenditure of City funds;

 

                     WHEREAS, in order to receive those funds the City and VDOT must enter into a Programmatic Project Administration Agreement [for] Revenue Sharing Projects (the “Programmatic Agreement”);

 

                     WHEREAS, the City and VDOT entered into a Programmatic Agreement dated August 13, 2013, for the three (3) fiscal years, beginning July 1, 2013 and ending June 30, 2016;

 

                     WHEREAS, by an extension addendum dated on or about June 3, 2016, the City and VDOT extended that Programmatic Agreement an additional three (3) fiscal years through June 30, 2019;

 

                     WHEREAS, by its terms that Programmatic Agreement shall not extend beyond six (6) fiscal years; and

 

                     WHEREAS, VDOT has agreed to enter into a new Programmatic Agreement with the City for the three (3) fiscal years beginning July 1, 2019 and ending June 30, 2022.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA: that the City Council hereby commits to fund its local share of preliminary engineering, right-of-way and construction (as applicable) of the project(s) under the Programmatic Agreement with the Virginia Department of Transportation applicable to the three (3) fiscal years beginnins July 1, 2019 and ending June 30, 2022, in accordance with the project financial document(s) related thereto and subject to appropriation by the City Council as those projects are specifically identified.

 

                     BE IT FURTHER RESOLVED that the City Manager or her authorized designee is authorized to execute a Programmatic Agreement and all agreements and any addendums thereto related to projects identified therein, in substantially the form attached to this resolution, and subject to approval by the City Attorney.
