Resolution to Amend the Fiscal Year 2019 Council Approved Budget and Accept and Appropriate the FY 2017 State Criminal Alien Assistance Program ("SCAAP") Payment Provided by the U.S. Department of Justice Bureau of Justice Assistance Pursuant to 8 U.S.C. § 1231(i)

Purpose

PURPOSE/BACKGROUND:

The Bureau of Justice Assistance, in conjunction with the Bureau of Immigration and Enforcement, the Citizenship and Immigration Services and the Department of Homeland Security, provides federal payments/funds to states and localities that incurred correctional officers'/deputies' salary expenses for incarcerating undocumented criminal aliens as require by 8 U.S.C. § 1231(i).  The payment is determined based on the number of qualifying inmates incarcerated during a specific 12 month period.  The FY 2017 payment is being made to entities that incurred costs from July 1, 2015 through June 30, 2017.  The funds provided must be used for correctional purposes.

Discussion:

The Hampton Sheriff's Office submitted an application for the FY 2017 SCAAP payment on October 26, 2018 to determine if any of the inmates met the SCAAP requirements.  The Hampton Sheriff's Office has met the requirements of the program and has been awarded $17,479.

Impact:

The payment of $17,479, with no local match required, will be used to cover medical services for the inmates incarcerated within the facilities.

                     WHEREAS, the Bureau of Justice Assistance has awarded the FY 2017 State Criminal Alien Assistance Program payment to the City of Hampton, Virginia in the amount of $17,749;

                     WHEREAS, the payment does not require a local match.

                     NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hampton, Virginia accepts and appropriates the FY 2017 State Criminal Alien Assistance Program payment award in the amount of $17,749 and any supplemental funding by the Bure...
