Ordinance Vacating A Portion Of A Certain 60’ Wide Public Right Of Way Designated As Freeman Drive Containing Approximately 1.141± Acres and 49,701± Square Feet Abutting Unaddressed Parcels Owned by the City of Hampton and Designated as LRSNs 13001179, 7000129, and 13001174
Purpose
Background Statement:
Approval of this ordinance would vacate, pursuant to Section 2.05 of the City Charter, a 1.141+/- acre portion of Freeman Drive abutting City-owned parcels designated as LRSNs 13001174, 13001179, and 7000129. This portion of Freeman Drive is being re-aligned and the area proposed for vacation will no longer be used as a public street. In addition, upon approval of the vacation, the City plans to vacate and adjust the boundary lines between several adjoining parcels in the vicinity, including the vacated former right-of-way area, to result in a new parcel of property for future development. That new parcel will be approximately 5.22 acres. This item is being brought forward in conjunction with Agenda item 19-0295, which if approved, would transfer that new parcel to the Hampton Redevelopment and Housing Authority.

WHEREAS, the City of Hampton is the owner of a certain public right of way known as Freeman Drive, a portion of which is proposed to be vacated and is which is more specifically depicted on the attached Exhibit A entitled, "Plat Showing Portions of Freeman Drive Right-of-Way Hereby Vacated," dated May 10, 2019, by Precision Measurements, Inc. (the "Freeman Drive Vacation Area");
WHEREAS, the Freeman Drive Vacation Area is abutting parcels of property currently owned by the City of Hampton and designated as LRSNs 13001179, 13001174, and 7000129;
WHEREAS, the City is in the process of re-aligning this portion of Freeman Drive, after which the Freeman Drive Vacation Area will no longer be used as a public street;
