Resolution Authorizing the Transfer From the City of Hampton To The Hampton Redevelopment and Housing Authority of Portions of LRSN 13001174, 13001179, and 7000129 As Well As A Portion of Freeman Drive To Be Vacated Containing an Approximate Total Of 5.22 ± Acres

 

Purpose

PURPOSE/BACKGROUND:

This item is being brought forward in conjunction with Agenda item 19-0294, which if approved, would vacate a portion of Freeman Drive abutting LRSNs 13001174, 13001179, and 7000129. Upon approval of the vacation, the City plans to vacate and adjust the boundary lines between several adjoining parcels in the vicinity, including the vacated former right-of-way area, to result in a new parcel of property for future development. That new parcel will be approximately 5.22 acres. The City Council has designated the Hampton Redevelopment and Housing Authority (HRHA) as the agency to implement the City's Community Plan as it relates to residential development and redevelopment with a residential component. Transfering the parcel to the HRHA is consistent with this policy and will allow the City to establish several easements for drainage, utilities, and public access. The transfer will not occur until all right-of-way vacation and boundary line adjustment and vacation plats have been approved and recorded.

Body

                     WHEREAS, the City of Hampton (“City”) owns three unaddressed and vacant parcels of land in the Coliseum Central area of the City of Hampton, Virginia known as LRSNs 13001174, 13001179, and 7000129 as well as a public right-of-way known as Freeman Drive, a portion of which is proposed to be vacated, portions of all of which are proposed to be combined into a new parcel of property designated as "FD1" on the attached plat entitled "Subdivision Plat of Parcel FD1 Standing in the Name of City of Hampton for Freeman Drive Reconstruction Project, Hampton Virginia," dated May 10, 2019, by Precision Measurements, Inc., which is attached hereto as Exhibit A (the "Property”);

                     WHEREAS, the City Council has designated the Hampton Redevelopment and Housing Authority (“HRHA”) as the agency to implement the City’s Community Plan as it relates to residential development and redevelopment with a residential component;

WHEREAS, the City accordingly desires to transfer title to the Property to the HRHA for redevelopment in accordance with the City’s Community Plan and to establish all such necessary easements through that transfer; and

WHEREAS, a public hearing has been conducted in accordance with Section 15.2-1800 et seq. of the Code of Virginia.

 

                     NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1.                     That it approves the transfer to the HRHA of the Property.

                     2.                     That the City Manager or her authorized designee and the Clerk be and are authorized to execute and deliver to the HRHA any and all necessary legal documents to effectuate the transfer; such documents shall include, but not be limited to, contracts, deeds, releases for sale, transfer, and conveyance of the Property described above.
