Ordinance to Amend And Re-Enact Chapter 2 Of The Zoning Ordinance Of The City of Hampton, Virginia Entitled, “Definitions” By Amending Section 2-2 Pertaining To Fences and Natural Fences

 

Purpose

Background Statement:

Approval of this amendment would add a definition for fence and natural fence, which are both referenced in Section 1-18, “Fence and Wall Regulations.”

 

This amendment is being brought forward in conjunction with a Zoning Ordinance Amendment (Item #20-0134) to make technical updates and, as part of adoption of a separate City Code Amendment (Item #20-0192), pertaining to enforcement of overgrown vegetation, would remove duplicative regulations.

Body

WHEREAS, the public necessity, convenience, general welfare and good zoning practice so require;

 

BE IT ORDAINED by the City Council of the City of Hampton, Virginia that Section 2-2 of Chapter 2 of the Zoning Ordinance of the City of Hampton, Virginia be amended to read as follows:

 

Sec. 2-2. - Definitions.

Fence. An accessory structure, including but not limited to a  barrier, railing, or other upright structure, constructed of materials of a nature to indicate a degree of intended permanence, the components of which are not readily or easily removed, that acts in the manner to prevent or eliminate vision, viewing, or access to a property. 

Fence, natural. Any natural or dense vegetation, including but not limited to hedges, trees and shrubs, that acts in the same manner as a fence to create a screen or barrier that operates to prevent or eliminate vision, viewing, or access to a property.
