Review and Approval of the Amendment and Extension of the Hampton-Newport News Community Services Board FY 2019-2020 Performance Contract with the Department of Behavioral Health and Development Services

Purpose

PURPOSE/BACKGROUND:
The Hampton-Newport News Community Services Board (“CSB”) annually submits to the City Council its performance contract for community mental health, development, and substance abuse services for approval as required by Virginia Code § 37.2-508. This contract is the primary accountability and funding mechanism between the Virginia Department of Behavioral Health and Developmental Services (“Department”) and the CSB. Before the Department approves the contract, the governing bodies of each city that established the CSB must approve the performance contract. The FY19 Contract was approved by motion on September 26, 2018. The FY20 Contract was approved by motion on September 25, 2019. The Performance Contract serves as a performance reporting and accountability document between the Department and the CSB.


Discussion:
The public health emergency created by the COVID-19 virus has warranted a need for flexibility with CSB requirements; flexibilities that are relevant to the delivery of services related to COVID-19 detection and treatment, as well as maximizing access to care and minimizing viral speed through community contact. Under those circumstances, the CSB desires to extend the term of its FY 2019 and FY 2020 Performance Contract from July 1, 2020 to December 31, 2020. The Department of Behavioral Health and Development Services has agreed to that extension, subject to amendments to add an Exhibit M (Department of Justice Settlement Agreement Requirements; formerly set forth in Section 4.q of the Performance Contract); and the deletion in entirety and replacement of Exhibits A, E, and F. By its terms, the amendment shall be retroactive to July 1, 2020.
