Resolution to Amend the Fiscal Year 2020 Council Approved Budget to Accept and Appropriate $2,475,088 in Additional Revenues (State and Other Funds) to the General Fund's School Operating Budget

 

Purpose

PURPOSE/BACKGROUND:

The Code of Virginia Section 22.1-94 states that a governing body may make appropriations to a school board from the funds derived from local levies and from any other funds available, for operation, capital outlay, and debt service in the public schools. Additionally, the Code of Virginia Section 22.1-88 states the funds available to the school board of a school division for the establishment, support and maintenance of the public schools in the school division shall consist of state funds appropriated for public school purposes and apportioned to the school board, federal funds appropriated for educational purposes and apportioned to the school board, local funds appropriated to the school board by a local governing body or such funds as shall be raised by local levy as authorized by law, donations or the income arising therefrom, and any other funds that may be set apart for public school purpose.

 

Discussion:

The School Board of the City of Hampton is requesting that the additional revenues (State and Other Funds) received for fiscal year 2020, in the amount of $2,475,088, be accepted and appropriated to the General Fund's School Operating Budget.

                     WHEREAS, the Code of Virginia Section 22.1-94 states that a governing body may make appropriations to a school board from the funds derived from local levies and from any other funds available, for operation, capital outlay, and debt service in the public schools;

 

                     WHEREAS, the Code of Virginia Section 22.1-88 states the funds available to the school board of a school division for the establishment, support and maintenance of the public schools in the school division shall consist of state funds appropriated for public school purposes and apportioned to the school board, federal funds appropriated for educational purposes and apportioned to the school board, local funds appropriated to the school board by a local governing body or such funds as shall be raised by local levy as authorized by law, donations or the income arising therefrom, and any other funds that may be set apart for public school purpose;

 

                     WHEREAS, the School Board of the City of Hampton, Virginia closed its books for fiscal year 2020 and reported additional revenues (State and Other Funds) in the amount of $2,475,088 due to exceeding the original projected average daily membership and final General Assembly changes in Sales Tax and Supplemental Lottery fund payments to the school division and exceeding the budget for other funds (primarily pharmacy revenue, Medicaid revenue, and print shop revenue);

 

                     WHEREAS, the School Board of the City of Hampton, Virginia did not utilize these funds for expenditures for fiscal year 2020; and

 

                     WHEREAS, the School Board of the City of Hampton, Virginia is requesting the additional revenues (State and Other Funds) for fiscal year 202 be appropriated to the Schools Operating Budget.

 

                            NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Hampton, Virginia hereby amends its Fiscal Year 2020 Council Approved Budget to accept and appropriate $2,475,088 in additional revenues (State and Other Funds) to the General Fund's School Operating Budget.

 

                     BE IT FURTHER RESOLVED that the City Council of the City of Hampton, Virginia authorizes the City Manager, or her designee, to take any and all actions necessary to implement this request.
