Ordinance to Amend and Reenact Section 24-39.1 of the City Code of the City of Hampton, Virginia, Entitled, “Open Storage of Inoperable Vehicles on Property Zoned For Other Than Residential Purposes” Pertaining to the Applicability of that Section to New Vehicle Sales

 

Purpose

PURPOSE/BACKGROUND:

Since the comprehensive change to the City's inoperable vehicles regulations in 2020, staff was asked to review the application of the new regulations to new car sales businesses. Upon review, staff determined that new car sales businesses were unnecessarily regulated. Approval of this amendment would exempt new car sales businesses from the City's existing commercial inoperable vehicles regulation if those new car sales business also engage in either heavy or light vehicle repair on the same property as the new car sales business.

                     BE IT ORDAINED by the Council of the City of Hampton, Virginia that Section 24-39.1 of the City Code of the City of Hampton, Virginia, be amended and re-enacted as follows:

 

CHAPTER 24 - OFFENSES-MISCELLANEOUS

ARTICLE I. - IN GENERAL

Sec. 24-39.1. - Open storage of inoperable vehicles on property zoned for other than residential purposes.

(h)                     The provisions of this section shall not apply to a property or parcel of land where the primary use of such property or parcel of land is “vehicle sales, new inventory lot” and an accessory use of such property or parcel of land is either “vehicle repair, heavy” or “vehicle repair, light” as those terms are defined in Section 2-2 of the Zoning Ordinance.
