Resolution to Amend the Fiscal Year 2022 Council Approved Budget to Accept and Appropriate $670,695 in SMART SCALE Funding from the Virginia Department of Transportation to the Capital Projects Fund for the North Armistead Avenue Reconstruction Project and Transfer Bond Funds of $480,000 from the Armistead Avenue Road Raising Stormwater Bond Project to the North Armistead Avenue Reconstruction Stormwater Bond Project

Purpose

 

The project will be a reconstruction of Armistead Avenue between Thomas Street and Convention Center Boulevard to mitigate drainage issues and provide pedestrian/ADA access and associated amenities along both sides of the roadway.

The North Armistead Avenue Reconstruction Project (UPC 115243) was included within the SMART Scale Round 3 applications in 2018.  Originally scheduled to begin in Fiscal Year 2024, the project was requested to be advanced due to cost savings, which could be realized if the project were to be run in tandem with the North Armistead Avenue Road Raising Resilience project in the same area of North Armistead Avenue.  The Virginia Department of Transportation (“VDOT”) has agreed to advance the project and program within the approved Six Year Improvement Plan.

WHEREAS, the North Armistead Avenue Reconstruction Project (UPC 115243) (the “Project”) was included within the Fiscal Year 2024 Capital Improvement Plan, but advancing the  Project to Fiscal Year 2022 to coordinate with the North Armistead Avenue Road Raising Resilience Project, currently under design, would be a cost savings measure;

 

                     WHEREAS, the Virginia Department of Transportation (“VDOT”) has advanced the project by including it in the Six Year Improvement Plan and appropriating $670,695 of Fiscal Year 2022 SMART SCALE Funding;

 

                     WHEREAS, these funds were not previously included in the Fiscal Year 2022 Council Approved Budget;

 

                     WHEREAS, the transfer of $480,000 from the Armistead Avenue Road Raising Stormwater Bond Project to the North Armistead Avenue Reconstruction Stormwater Bond Project can be utilized as the required local contribution if transferred to the Project; 

 

                     WHEREAS, Hampton City Charter Sec. 6.12 and Hampton City Code Sec. 2-137 requires that City Council approve the transfer of unencumbered bond  proceeds;

 

                      WHEREAS, the VDOT share of these funds will be paid on a reimbursement basis following the expenditure of City funds; and

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA, amends the Fiscal Year 2022 Council Approved Budget and hereby accepts $670,695 in SMART SCALE Funding from the Virginia Department of Transportation and appropriates those funds to the Capital Projects Fund for the North Armistead Avenue Reconstruction Project and transfers bond proceeds of $480,000 from the Armistead Avenue Road Raising Stormwater Bond Project to the Capital Projects Fund for the North Armistead Avenue Reconstruction Stormwater Bond Project.

                    

                     BE IT FURTHER RESOLVED, that the City Manager, or her authorized designee, is hereby authorized to take any and all necessary action to carry out the purposes of this Resolution, subject to approval by the City Attorney.
