Resolution to Amend the Fiscal Year 2022 Council Approved Budget and Appropriate $85,283.28 from the Hazmat Restricted Fund Balance to the Fire and Rescue Division's General Fund Operating Budget
Purpose
PURPOSE/BACKGROUND:
The Fire and Rescue Division utilizes Hazmat Recovery Funds to fund the cost of materials and equipment needed to respond to hazmat emergencies and other related situations, which are not covered by the Fire and Rescue Division's operating budget or other grant funds.

WHEREAS, the Commonwealth of Virginia, Code of Virginia, Title 15-2 Counties, Cities, and, Towns, Chapter 9 General Powers of Local Government, Virginia Code 15-2-900 Abatement or Removal of nuisances by localities; recovery of cost states that counties, cities, and towns may bring action against the responsible party of a nuisance such as hazardous materials;
WHEREAS, the Hampton, Virginia, Code of Ordinances, Chapter 14 - Fire Prevention and Protection, Article V - Hazardous Materials, Section 14-87 - Establishment of Revolving Account states that the City has a Hazmat Revolving Account within the General Fund; and
WHEREAS, the Hampton, Virginia, Code of Ordinances, Chapter 14 - Fire Prevention and Protection, Article V - Hazardous Materials, Section 14-87 Disposition of Funds Collected states that all funds collected shall be used for hazardous materials emergencies and to recoup costs associated with a response to a hazardous materials emergency.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hampton, Virginia hereby amends its Fiscal Year 2022 Council Approved Budget and appropriates $85,238.28 from the Hazmat Restricted Fund Balance to the Fire and Rescue Division's General Fund operating budget to fund the cost of materials and equipment needed to respond to hazmat emergencies and other relate...
