Resolution Requesting that the Virginia Department of Transportation Program the Arconic Pedestrian Improvements Project into its Six-Year Improvement Plan and to Authorize the City Manager or her Designee to Execute Any Necessary Agreements

 

Purpose

PURPOSE/BACKGROUND:

 

The purpose of the Arconic “Howmet Drive” Pedestrian Improvements Project (the “Project”) is to install ADA compliant ramps, sidewalks, crosswalks and associated traffic controls in Copeland Industrial Park adjacent to the Arconic Power and Production Products plant facility.  City Council previously approved this Project in July 2018 by Resolution #18-0246 and submitted same to the Virginia Department of Transportation (“VDOT”) when the Commonwealth Transportation Board initially approved the VDOT Six-Year Improvement Program.  The project, while approved in 2018, no funding was expected until FY2024.  Now that it is FY2024, VDOT has requested an updated resolution from the City for this Project since the prior resolution was approved over five years ago.  In accordance with the VDOT project allocation procedures, in order to receive VDOT funding support, City Council must request by resolution that VDOT program each highway project; and must authorize the City Manager or her designee to execute project administration agreements and any other City/State Agreements for implementation of these projects.  Once and approved and programmed, VDOT will allocate sufficient federal and state funds to fully fund the Project.  The funds are reimbursable by VDOT and are paid on a reimbursement basis following the expenditure of City funds.

                      WHEREAS, in accordance with the Virginia Department of Transportation (“VDOT”) project funding allocation procedures, the City Council, by resolution, must request VDOT to program highway projects in the City of Hampton (the “City”);

 

                     WHEREAS, City Council previously approved the Arconic “Howmet Drive” Pedestrian Improvements Project (the “Project”) in July 2018 by Resolution #18-0246 and submitted same to the Virginia Department of Transportation (“VDOT”) to be included in the VDOT Six-Year Improvement Program. 

                     

                     WHEREAS, the purpose of the Project is to install ADA compliant ramps, sidewalks, crosswalks and associated traffic controls in Copeland Industrial Park adjacent to the Arconic Power and Production Products plant facility; 

 

                     WHEREAS,  while the Project was approved in 2018, no funding was anticipated until FY2024, and VDOT has now requested an updated resolution from the City for this Project since the prior resolution was approved over five years ago.  

 

                              WHEREAS, once approved and programmed, VDOT will allocate sufficient federal and state funds to fully fund the Project;

 

                                WHEREAS, VDOT has indicated that it is prepared to program funds to be used by the City for the Project and has assigned UPC 113855 to the Project;

                    

                               WHEREAS, a project administration agreement with VDOT is necessary for securing VDOT commitment on the funding for the Project;

 

                      WHEREAS, VDOT requires that City Council grant authority for the City Manager or her designee to execute the project administration agreement and any other City/State Agreements for implementation of the Project; and

 

                     WHEREAS, these funds are reimbursable and paid on a reimbursement basis following the expenditure of City funds.

 

                            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, VIRGINIA that for the purpose of the Project:

 

                     A.                     That the Virginia Department of Transportation is requested to program Arconic Pedestrian Improvements Project into its Six-Year Improvement Plan; and                   

 

                     B.                     That the City Manager or her authorized designee is hereby authorized to execute and deliver the project administration agreement and any and all documents necessary to carry out the purposes of this Resolution, subject to approval by the City Attorney and future appropriation of any necessary funding.
