Resolution of Support for the SMART SCALE Round 6 Chesapeake Avenue Corridor Improvement Project
Purpose
PURPOSE/BACKGROUND:
The City of Hampton (the “City”) has identified the Chesapeake Avenue Corridor Improvement Project (the "Project") that qualifies for Virginia Department of Transportation (“VDOT”) funding consideration under the SMART SCALE program. This program funds projects on a 100% Federal and State reimbursement basis. The Project proposes to construct a shared use path along Chesapeake Avenue on the eastbound side adjacent to the Chesapeake Bay, from Claremont Avenue to LaSalle Avenue, a distance of approximately 1.5 miles. The Hampton Roads Transportation Planning Organization (“HRTPO”) provided support for the City’s application at the May 16, 2024 meeting.

WHEREAS, in accordance with the Commonwealth Transportation Board construction allocation procedures, the City of Hampton (the “City") must provide a resolution to the Virginia Department of Transportation (“VDOT”) to request VDOT to establish a SMART SCALE project in the City;
WHEREAS, the City has identified the Chesapeake Avenue Corridor Improvement Project (the "Project") that qualifies for VDOT funding consideration under the SMART SCALE Program;
WHEREAS, the Project proposes to construct a shared use path along Chesapeake Avenue from Claremont Avenue to LaSalle Avenue, a distance of approximately 1.5 miles;
WHEREAS, the SMART SCALE Program funds projects on a 100% Federal and State share basis.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:
A. That the City Council of Hampton hereby requests the Commonwealth Transportation Board to establish a SMART SCALE project in the City to construct the Chesapeake Avenue Corridor Improvement Project;
B. That the City agrees to enter into a project administration agreement with VDOT for the Project and provide the necessary oversight to ensure the Project is developed in accordance with all state and federal requirements for design, right of way acquisition, and construction of a federally funded transportation project;
C. That the City will be responsible for maintenance and operating costs of any facility constructed with SMART SCALE funds unless other arrangements have been made with VDOT;
D. That the City understands that if the City subsequently elects to cancel the Project, the City must reimburse VDOT for the total amount of costs expended by VDOT through the date VDOT is notified of such cancellation;
E. That the City agrees to repay any funds previously reimbursed that are later deemed ineligible by the Federal Highway Administration; and
F. That the City Manager or her authorized designee is hereby authorized to execute and deliver any and all documents necessary to carry out the purposes of this Resolution, subject to approval by the City Attorney.
