Title

Resolution to Amend the Fiscal Year 2022 Council Approved Budget and to Accept and Appropriate $943,831 in Additional Congestion Mitigation and Air Quality Funding from the Virginia Department of Transportation to the Capital Projects Fund for the Citywide Traffic Signal Upgrades - Phase IV Project

 

Purpose

PURPOSE/BACKGROUND:

The Citywide Traffic Signals Upgrades - Phase IV Project (UPC 116318) (the “Project”) will upgrade traffic signal system communications and operating components citywide.  Virginia Department of Transportation (“VDOT”) and Hampton Roads Transportation Planning Organization (“HRTPO”) identified a surplus of $943,831 in Congestion Mitigation and Air Quality (“CMAQ”) funding during a reconciliation of completed projects in the region.  HRTPO held the surplus funds in a balance entry account in order to keep the funding within the City of Hampton, with the funds now being held by VDOT for disbursement.  The HRTPO Board approved the transfer of the surplus funds to the Project on May 20, 2021, and submitted a Transportation Improvement Program (“TIP”) amendment to the Commonwealth Transportation Board (“CTB”).  CTB approved the funds to be transferred to the Project which now requires City Council resolution to appropriate the funds to be added to the Fiscal Year 2022 Council Approved Budget.

                    WHEREAS, in accordance with Virginia Department of Transportation ("VDOT") project allocation procedures, City Council must request, by resolution, that VDOT appropriate funds to highway projects in the City of Hampton;

 

                     WHEREAS, VDOT, the Hampton Roads Transportation Planning Organization (“HRTPO”), and the Commonwealth Transportation Board (“CTB”) have agreed to pay to the City the sum of $943,831 in surplus Congestion Mitigation and Air Quality (“CMAQ”) funding for the Citywide Traffic Signals Upgrade - Phase IV Project (UPC 116318);

 

                     WHEREAS, these funds were not previously included in the Fiscal Year 2022 Council Approved Budget; and

 

           WHEREAS, VDOT will pay those funds to the City on a reimbursement basis following the expenditure of City funds.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON that it amends the Fiscal Year 2022 Council Approved Budget and hereby agrees to accept from VDOT  $943,831 in surplus CMAQ funding and appropriates  those funds to the Capital Projects Fund for the Citywide Traffic Signals Upgrade - Phase IV Project; and

                     BE IT FURTHER RESOLVED that the City Manager, or her authorized designee, is hereby authorized to take any and all necessary actions to carry out the purposes of this Resolution, subject to the approval by the City Attorney.
