Resolution of Endorsement of Round Seven SMART SCALE Projects

 

 

Purpose

The City of Hampton (the “City”) has identified two projects that potentially qualify for Virginia Department of Transportation (“VDOT”) consideration under the SMART SCALE Program.  This program funds projects on a 100% Federal and State share basis.  The two projects are:

 

            1.  Briarfield Road and Power Plant Parkway Improvements Project -proposes to install pedestrian improvements, upgrading intersection lighting, replace span wire signal supports with mast arm signals and roadway realignment; and

 

            2.  Pedestrian Bridge over Mercury Boulevard Project - proposes a pedestrian bridge structure between the intersections of Kilgore Avenue and Coliseum Drive to provide a dedicated crossing for pedestrians traveling across Mercury Boulevard and a continuous connection from the Coliseum area south of Mercury Boulevard to the commercial district located to the north.

Body

                     WHEREAS, in accordance with the Commonwealth Transportation Board construction allocation procedures, the City of Hampton (the “City") must provide a resolution of endorsement to the Virginia Department of Transportation (“VDOT”) to request VDOT to establish SMART SCALE projects in the City;

 

                     WHEREAS, the City has identified two projects that potentially qualify for VDOT funding consideration under the SMART SCALE Program:

 

            1.  Briarfield Road and Power Plant Parkway Improvements Project - proposes to install pedestrian improvements, upgrading intersection lighting, replace span wire signal supports with mast arm signals and roadway realignment; and

 

            2.  Pedestrian Bridge over Mercury Boulevard Project - proposes a pedestrian bridge structure between the intersections of Kilgore Avenue and Coliseum Drive to provide a dedicated crossing for pedestrians traveling across Mercury Boulevard and a continuous connection from the Coliseum area south of Mercury Boulevard to the commercial district located to the north.

 

                         The two projects collectively being referred to as the “Projects”; and

                     

                     WHEREAS, this SMART SCALE Program funds projects on a 100% Federal and State share basis. 

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:

 

                     A. That the City Council of Hampton hereby requests the Commonwealth Transportation Board to establish a SMART SCALE project in the City to construct the Projects;

 

                     B. That the City agrees to enter into a project administration agreement with VDOT for each project and provide the necessary oversight to ensure these projects are developed in accordance with all state and federal requirements for design, right of way acquisition, and construction of a federally funded transportation project;

 

                     C. That the City will be responsible for maintenance and operating costs of any facility constructed with SMART SCALE funds unless other arrangements have been made with VDOT;

 

                     D. That the City understands that if the City subsequently elects to cancel any of these projects, the City must reimburse VDOT for the total amount of costs expended by VDOT through the date VDOT is notified of such cancellation;

 

                     E. That the City agrees to repay any funds previously reimbursed that are later deemed ineligible by the Federal Highway Administration; and

 

                     F. That the City Manager or her authorized designee is hereby authorized to execute and deliver any and all documents necessary to carry out the purposes of this Resolution, subject to approval by the City Attorney.
