Ordinance To Amend And Re-Enact The Zoning Ordinance Of The City Of Hampton, Virginia by Amending Section 9-23 Entitled “Modifications to Permitted Uses” Pertaining to Prohibited Uses in the Coliseum Central Overlay
Purpose
Background Statement:
Approval of this amendment would exclude Storage Facility 1, Storage Facility 2, and Storage Facility 3 as a permitted use within the overlay district boundaries. This Zoning Ordinance Amendment is proposed in conjunction with Zoning Ordinance Amendments 19-00005 (Granicus File #19-0259) Chapter 2 Definitions and 19-00006 (Granicus File #19-0260) Chapter 3 Permitted Uses. Engagement with stakeholders, such as the Coliseum Central Business Improvement District (CCBID) Board, is necessary prior to recommending a zoning ordinance amendment for the Coliseum Central Overlay District. This may be a time consuming process to make sure the most appropriate treatment occurs in the Coliseum Central area, which is a master plan area and the city’s most contemporary business district where an effort is being made to create an active pedestrian friendly environment. Therefore, staff is asking that the changes to the ordinance be approved, permitting the new distinctions take effect elsewhere in the city while staff solidifies the best solution for Coliseum Central. This will temporarily create a prohibition on new self-storage facilities in Coliseum Central until such time as the district is amended by City Council to permit them.

Ordinance To Amend And Re-Enact The Zoning Ordinance Of The City Of Hampton, Virginia by Amending Section 9-23 Entitled “Modifications to Permitted Uses” Pertaining to Prohibited Uses in the Coliseum Central Overlay
WHEREAS, the public necessity, convenience, general welfare and good zoning practice so require;
BE IT ORDAINED by the Council of the City of Hampton, Virginia that Section 9-23 of the Zoning Ordinance of the City of Hampton, Virginia, be amended and re-enacted as follows:
Chapter 9 - OVERLAY DISTRICTS
ARTICLE III. - O-CC DISTRICT-COLISEUM CENTRAL OVERLAY
Sec. 9-23. - Modifications to permitted uses.
(1) Permitted uses shall be defined by the base zoning of the individual properties with the following modifications:
(a)Prohibited uses:
(i) Boarding house;
(ii) Funeral home;
(iii) Mobile/manufactured home park and subdivision;
(iv) Pawnshop;
(v) Rooming house;
(vi) Sign painting shop;
(vii) Tattoo parlor;
(viii) Turkish bath;
(ix) Detention facility;
(x) Group home 2;
(xi) Halfway house;
(xii) Juvenile residence;
(xiii) Orphanage;
(xiv) Shelter;
(xv) Mental health/substance abuse treatment facility;
(xvi) Shooting range, trap or skeet;
(xvii) Boathouse, pier, dock, ramp; commercial (public or private);
(xviii) Marina, including boat sales, rental, storage and fuel.
